Waiver and Release
I, the participant, acknowledge and agree to the following:
1. Assumption of Risk
I acknowledge that participation in pickleball activities, including but not limited to games, training, coaching, competitions, social play, and use of the facilities, involves inherent and obvious risks. These risks include, but are not limited to, slips, trips, falls, collisions, overexertion, equipment failure, and physical injury. I voluntarily choose to participate and assume full responsibility for all risks, whether known or unknown, inherent or incidental, arising from my participation.
2. Release and Waiver (to the extent permitted by law)
To the fullest extent permitted by law, I release, discharge, and hold harmless Pickleball Central Pty Ltd, its directors, officers, employees, contractors, volunteers, coaches, agents, facility owners, and other participants from any and all claims, demands, actions, or causes of action arising out of or in connection with my participation in pickleball activities.
3. Indemnity
I agree to indemnify and keep indemnified Pickleball Central Pty Ltd against any loss, damage, cost, or expense (including legal costs) arising from my actions or omissions while participating in activities at the facility, including claims made by third parties.
4. Compliance with Rules and Safety Directions
I agree to comply with all rules, policies, safety instructions, signage, and directions issued by staff. I acknowledge that failure to do so may result in removal from the facility or activities without refund.
5. Fitness to Participate
I declare that I am medically and physically fit to participate and have not been advised otherwise by a qualified medical practitioner. I acknowledge that participation is at my own risk and that I am responsible for monitoring my own physical condition.
6. Medical Treatment Consent
In the event of injury or medical emergency, I authorise Pickleball Central Pty Ltd and its staff to obtain medical treatment for me (or my child) as deemed necessary. I accept responsibility for any costs associated with such treatment.
7. Photographic and Media Release
I grant permission for photographs, video recordings, or other media of me (or my child) taken during activities to be used for promotional, marketing, or operational purposes without compensation.
8. Minors (if applicable)
Where the participant is under 18 years of age, I confirm that I am the participant’s parent or legal guardian and agree to this waiver on their behalf.
9. Severability
If any provision of this waiver is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. Governing Law
This waiver is governed by the laws of Victoria, Australia, and the parties submit to the exclusive jurisdiction of the courts of Victoria.
11. Acknowledgement
I acknowledge that I have read and understood this waiver, that I am signing it voluntarily, and that it is binding on me and, where applicable, my heirs and legal representatives.
